These Terms & Conditions govern the relationship between Wild Artistic Photography Tours and Workshops (FA Budai) ABN 83 963 297 731 ("Wild Artistic Photography", "we", "us", or "our") and any person booking or participating in a tour, workshop, or lesson ("participant", "client", or "you").

By booking with Wild Artistic Photography Tours and Workshops, you agree to be bound by these Terms & Conditions.

1. Booking and Payment

A booking is confirmed when:

  • A completed booking form has been received, and
  • The required deposit payment has been made.

A non-refundable deposit of 30% of the total tour price is required to secure a place on the tour.

The remaining balance must be paid no later than 60 days prior to the tour start date.

Bookings made within 60 days of departure require full payment at the time of booking.

If the balance is not received by the due date, Wild Artistic Photography reserves the right to cancel the booking and retain the deposit.

All prices are listed in Australian Dollars (AUD) and are inclusive of GST unless otherwise stated.

2. Cancellation by the Participant

If a participant cancels their booking, the following cancellation fees apply:

No refund will be given for:

  • Failure to join the tour
  • Late arrival
  • Early departure
  • Missed activities

Participants are strongly advised to obtain comprehensive travel insurance covering cancellation.

3. Cancellation by Wild Artistic Photography

Wild Artistic Photography reserves the right to cancel a tour due to circumstances including but not limited to:

  • Insufficient participant numbers
  • Safety concerns
  • Severe weather conditions
  • Natural disasters
  • Government restrictions
  • Force majeure events

If a tour is cancelled by Wild Artistic Photography, participants will be offered:

  • A full refund of payments made, or
  • Transfer to another available tour

Wild Artistic Photography is not responsible for additional costs incurred, including flights, accommodation, travel insurance, or equipment rental.

4. Minimum Participant Numbers

Some tours require a minimum number of participants to operate. If the minimum number is not reached, Wild Artistic Photography reserves the right to cancel the tour. Participants will be notified as early as possible.

5. Itinerary Changes

Photography tours require flexibility due to changing environmental conditions. Wild Artistic Photography reserves the right to modify locations, accommodation, transport, and daily schedules due to:

  • Weather conditions
  • Wildlife activity
  • Safety considerations
  • Access restrictions

These changes are made to ensure the best photographic opportunities and participant safety and do not constitute grounds for refund.

6. Travel Insurance

Participants must obtain comprehensive travel insurance covering:

  • Medical expenses
  • Trip cancellation
  • Personal liability
  • Personal belongings and camera equipment

Wild Artistic Photography strongly recommends insurance that includes trip interruption and evacuation coverage.

7. Health and Physical Requirements

Photography tours may involve walking on uneven terrain, early morning or late evening outings, remote locations, and variable weather conditions.

Participants must ensure they are physically capable of participating in the activities described in the tour information.

Participants are responsible for informing Wild Artistic Photography of any medical conditions that may affect their participation.

8. Participant Conduct

Participants are expected to behave in a respectful and responsible manner. Wild Artistic Photography reserves the right to remove any participant whose behaviour endangers themselves or others, disrupts the group, or violates local laws. In such cases no refund will be provided.

9. Equipment Responsibility

Participants are fully responsible for their own equipment and personal belongings. Wild Artistic Photography accepts no responsibility for loss, theft, or damage to personal photography equipment during the tour. Participants should ensure their equipment is covered by insurance.

10. Photography Outcomes

Photography tours depend on natural conditions. Wild Artistic Photography cannot guarantee specific weather conditions, sunrise or sunset visibility, wildlife sightings, or seasonal conditions. These elements are beyond our control and form part of the nature of outdoor photography.

11. Third-Party Services

Accommodation, transportation, and other services used during the tour are provided by independent third-party suppliers. Wild Artistic Photography acts as an intermediary in arranging these services and accepts no responsibility for their acts, omissions, or service interruptions.

12. Limitation of Liability

Participation in photography tours involves inherent risks. To the fullest extent permitted by law, Wild Artistic Photography and its owners, employees, contractors, and partners shall not be liable for personal injury, illness, property damage, loss or delay, or travel disruption arising from participation in the tour.

Liability, where applicable, is limited to the amount paid for the tour.

Nothing in these Terms excludes rights under Australian Consumer Law where such rights cannot legally be excluded.

13. Force Majeure

Wild Artistic Photography is not responsible for delays, changes, or cancellations caused by events beyond our control, including but not limited to natural disasters, severe weather, government actions, public health emergencies, transport disruptions, or civil unrest.

14. Media and Promotional Use

During the tour, Wild Artistic Photography may take photographs or video that include participants. These images may be used for website content, marketing materials, and social media.

Participants who do not wish to appear in such media should notify Wild Artistic Photography in writing before the tour begins.

Participants retain full copyright of their own photographs.

15. Governing Law

These Terms & Conditions are governed by the laws of Tasmania, Australia. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Tasmania.

16. Acceptance of Terms

By booking with Wild Artistic Photography Tours and Workshops (FA Budai) ABN 83 963 297 731, participants confirm that they have read these Terms & Conditions, understood them, and agreed to be bound by them.
